1. HOW TO ENTER
a. The MOViN 997 “Bay Area’s PYT” contest (“Contest”) will begin on April 27th, 2009 at 6:00am Pacific Time (“PT”) and end on June 6th, 2009 at 8:00am PT. Entries may be submitted online between April 27th, 2009 at 6:00am PT and May 10th, 2009 at 11:59pm PT (“Entry Period”).
b. To participate in the Contest, listeners must visit www.movin997.com, and, following the Contest links and instructions, complete and submit an online entry form during the Entry Period. As part of their entry, the entrants must upload one photograph of their nominee for the “Bay Area’s PYT”. The photograph uploaded must be under 2 megabytes (MB) in size, no more than 400x300 pixels in landscape dimension or 300x400 pixels in portrait dimension, and in .JPG or .GIF formats only. In addition, entrants must also fill out a completed parental consent release form to verify their entry into the Contest. Online entries must include the entrant’s first and last name, complete address, including ZIP Code, their date of birth, telephone number, and valid email address as well as the Nominee’s name and telephone number. All entries must be received by May 10th, 2009 at 11:59pm PT.
c. Upon review by MOViN 997 (KMVQ) (the “Station”), all eligible and verified Photo Submissions will be posted online at www.movin997.com, where listeners will be able to vote on their favorite Photo Submissions. A preview day will be launched on the website beginning Wednesday, May 13h, 2009 at 11:59am PT until Thursday, May 14th, 2009 at 11:59am PT. During this period, entrants can verify their entries and notify KMVQ should their verified entry not be included in the preview gallery. There will be two periods of online voting. The first will occur from May 15th, 2009 at 12:01am PT to May 25th, 2009 at 11:59pm PT. This period will narrow down the field from all eligible photo submissions to the top 25 vote-getters. The second round of voting will occur from May 27th, 2009 at 12:01am PT to June 3rd at 1159pm PT. This round of voting will narrow the field from the top 25 vote-getters of Round One to the grand prize winner for the Bay Area’s PYT 2009 Contest.
d. Babies in the photo must be 36 months of age or younger at the time of entry and must be submitted by the child’s parent or legal guardian only.
e. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by the Station. The Station’s computer is the official timekeeping device for this Contest.
f. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
g. All Participant Releases and Photo Submissions submitted as part of this Contest must be the original creative work of the entrant and must not contain any copyrighted materials or any other materials which may be restricted, prohibited, or outlawed by Federal, state or local laws. All entries and their content become the property of the Station and will not be returned. The Station, in its sole discretion, reserves the right to disqualify and/or destroy any entry if the Photo Submission contains illegal, indecent, pornographic, sexually explicit content, or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse, or if such entry contains material whose content is deemed at the sole discretion of the Station to be unsuitable for public viewing or posting via the internet.
h. By entering the Contest, you are verifying that you are both the parent and/or legal guardian of the baby in the submitted photo, and the owner and producer of the submitted material and that no third party ownership rights exist to the photograph submitted. By entering the Contest, you are transferring all ownership rights of your submitted photograph to the company, was defined above. Your submitted photograph will not be returned and you will not be permitted to use the submission for any commercial use after it has been submitted.
i. All entrants will be required to agree to the terms of a “click-through” release as a condition of entering the Contest.
2. ELIGIBILITY RESTRICTIONS
a. Entrants and must be California residents, 21 years of age or older. Employees of the Station, its licensee, its parent, subsidiary and affiliated entities, its advertising and promotional agencies, participating sponsors, other radio stations in the San Francisco/Oakland/San Jose metropolitan area and the members of their immediate families and/or households are ineligible to participate or win.
b. Winners must provide proof of eligibility by presenting valid state or government issued photo identification and will be required to sign an affidavit of eligibility release form prior to acceptance of prize.
c. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. PRIZES
a. One (1) Grand Prize will be awarded. The Grand Prize is a trip for two (Grand Prize winner and guest) to London, England. Grand Prize shall include round trip coach class airfare for two from San Francisco to London, England on a carrier and route of Station’s choice, three (3) nights double occupancy hotel accommodations, and a pair of tickets to see Michael Jackson at the O2 Arena in London, England on September 8th, 2009. Grand Prize Approximate Retail Value (“ARV”): $3200.00, but ARV may vary depending upon the date of departure and airfare in effect at time of travel. Travel shall be based on availability; blackout dates and restrictions apply. All other costs, including but not limited to meals, ground transportation, entertainment, tips and incidental expenses are not included in the prize and are the sole responsibility of the Grand Prize winner and his or her guest. The Grand Prize winner and his or her guest must travel on the same itinerary and the trip must be booked per the instructions on the prize certificates. Any extensions or upgrades at the Grand Prize winner’s request, if permitted or available, shall be at the Grand Prize winner’s expense. Once the trip is confirmed, changes (guest’s name, date, etc) may result in change fees that will solely be the Grand Prize winner’s responsibility. Prize certificates are non-replaceable, and have no value, if lost, stolen, destroyed or expired. The guest of the Grand Prize winner must also be 21 years of age or older. Grand Prize winner and guest must meet any travel related requirements established by the carrier or by Federal, state, local or governments. Travel documentation is solely the responsibility of the Grand Prize winner and guest.
b. There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of the Station management with respect to the Contest are final.
b. Starting on May 13th, 2009 at approximately 11:59am PT, the Station will post online the Photo Submissions of the valid entries upon receipt on www.movin997.com. The Station will invite listeners to visit www.movin997.com and vote for their favorite Nominee during the First Online Voting Period. Listeners can vote once per email address per voting round. The First Online Voting Period will begin on May 15th, 2009 at 12:01am PT and end on May 25th at 11:59pm PT.
c. Upon conclusion of the First Online Voting Period, the twenty-five (25) entrants with the highest number of votes will be deemed potential Finalists, pending verification of eligibility and compliance with the Official Rules. In the event of a tie, the Station reserves the right to break the tie in a random drawing of the tied Nominees. The Station will notify the legal guardians of the entrants featured in the Photo Submission of each Finalist entry by telephone on May 26th, 2009 that they are one of the twenty-five (25) finalists. The Second Online Voting Period will begin on May 27th, 2009 at 12:01am PT and end on June 3rd, 2009 at 11:59pm PT. Upon conclusion of the Second Online Voting Period, the Finalist who receives the highest number of votes will be declared the potential Grand Prize winner, pending verification of eligibility and compliance with the Official Rules. In the event of a tie, the Station reserves the right to break the tie in a random drawing of the tied Nominees. The Station will notify the potential Grand Prize Winner entry by telephone on June 5th, 2009. The grand prize winner must execute and return any required affidavit of eligibility and/or liability/publicity release by 10:00am PT on Friday, June 19th, 2009 or the prize will be forfeited.
d. The Grand Prize Winner will be announced on the air and does not need to be present to win. Grand Prize winner will also be notified by phone and will be required to execute and return any required affidavit of eligibility and/or liability/publicity release within seven (7) days of being selected as the Grand Prize winner or the prize will be forfeited.
e. If a potential Finalist or the Grand Prize winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.
b. By participating in the sweepstakes, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this sweepstakes without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require Contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
d. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s website or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the sweepstakes if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Station reserves the right to make changes in the rules of the Contest, including the substitution of a prize or equivalent value, which will become effective upon announcement: If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.
f. Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
h. For the names of the prize winners, send a self-addressed stamped envelope for receipt by December 31, 2009 “MOViN 997’s Bay Area’s PYT- Winners, Attn: Promotions, KMVQ, 865 Battery St, 2nd Floor, San Francisco, California 94111. For Official Rules, send a self-addressed stamped envelope to the above address marked “MOViN 997’s Bay Area’s PYT - Official Rules” for receipt by June 5th, 2009. The names of Grand Prize Winner and the Official Rules will also be posted at www.movin997.com.
